Compliance with environmental legislation: “green waves” as a tool for reducing transport emissions in megapolises

Abstract:
Introduction. This article analyses the legal regulation of the use of “green wave” intelligent transport systems (hereinafter referred to as ITS) in the context of compliance with the requirements of the Russian Federation’s environmental legislation. The study demonstrates the relevance of using automatic trac light control systems as a tool for reducing transport emissions into the atmosphere of large cities. The objective of the study is to identify shortcomings in the legal regulation of the implementation of “green wave” systems and to develop proposals for improving mechanisms to incentivise local authorities to use ITS for environmental purposes through a system for evaluating the effectiveness of their activities. Methods. A range of approaches, including formallegal, comparative-legal and systemic methods, analysis of statistical data and law enforcement practice were employed in the study. Results. It has been established that current legislation does not contain specific provisions encouraging the introduction of “green waves” systems as a preventive measure to reduce emissions. The system of administrative responsibility cannot be used to incentivise local authorities, as they are not subject to liability under the Code of the Russian Federation on Administrative Offences. Conclusion. It is proposed that the Key Performance Indicators for local government bodies be supplemented by new indicators reflecting the extent of the implementation of “green waves” systems on highways with high traffic intensity where maximum permissible concentrations of pollutants are systematically exceeded. This proposal is in accordance with Decree of the President of the Russian Federation No. 607 of 28 April 2008 and Resolution of the Government of the Russian Federation No. 1317 of 17 December 2012.
