Corruption in the land trade sector as a threat to economic security

Abstract:
Introduction. Corruption in the land trade sector poses a significant threat to the economic security of the state, as land is a limited, highly liquid and strategically important resource. The relevance of the subject is due to the fact that violations in the allocation, registration, change of status and expropriation of land plots lead to losses in budget revenue, reduction of the investment attractiveness of territories, exacerbation of social inequality and undermining of trust in state institutions. The research aims to identify the main corruption risks and typical schemes in the field of land relations, as well as to outline areas for improving law enforcement practices and preventing corruption. Materials and methods. The research is based on materials from prosecutorial supervisory, judicial and law enforcement practices, as well as academic sources on issues of corruption, economic security and land relations. Methods of legal, institutional and comparative analysis are employed, enabling corruption to be examined as a consequence of a complex and insufficiently transparent system for regulating officials’ discretionary authorities. Results. Persistent corruption practices have been identified in the land trade sector: the allocation of land plots to affiliated parties without tenders, manipulation of land categories and types of permitted use, fictitious auctions, and the unlawful registration of rights. The common feature of such schemes has been found to be the use of official position to benefit interested parties. It has been concluded that there is the need to minimise administrative discretion, increase the level of prosecutorial supervision, digitise procedures and improve the transparency of land allocation.
